The Role and the Team
The Senior HR Accommodations Business Partner will serve as the centralized point of contact for employee, HR Business Partners, and Management inquiries about the accommodations and leave programs and serve as an employee advocate, by ensuring their needs are met in a timely manner. In addition, they will coordinate and support the process for providing reasonable accommodations for employees with religious accommodations, disabilities/medical, return to site and/or other accommodation requests. This individual will collaborate with HRBP’s, team leaders and employees to ensure that best practices, reasonable accommodations, applicable policies, and services are in place and coordinate compliance with regards to religious accommodations, the Americans with Disabilities Act Amendments Act (ADAAA) and California employment and privacy laws surrounding employees with disabilities and/or applicable state or federal laws. The successful candidate will support the development and implementation of a hybrid and/or stay at work program as well as programs to support employees returning to work. This role will also work closely identifying new projects to build effective plans to mitigate risk by analyzing data trends. The incumbent may also serve as the subject matter expert for FMLA, ADA accommodations, and all other Leaves of Absence (LOAs).
Engage in and document the interactive process with employees requesting accommodations due religious beliefs and/or medical needs; engages in the interactive process with employees and medical providers requesting additional information for clarity if limitations listed are vague.
Analyze accommodation trends, information, and data necessary to define and discern pattern matching.
Negotiate reasonable alternative accommodations, or may deny requests based on relevant factors, when appropriate.
Coordinate the return to work, accommodations, and assignment program monitoring.
Maintains complete and accurate records of accommodation requests in accordance with specified legal requirements and documentation of best practices.
Preserves confidentiality of employee religious beliefs and/or medical documentation and files as applicable.
Partners appropriately with legal counsel (internal and external) as needed / required.
Adept understanding of global environment.
Integrates and partners with Benefits and external leave administrator to implement solutions and help scale.
What you bring to the table:
Bachelor’s Degree in Business or Human Resources Management, or closely related field; SHRM Certification or PHR Certification highly preferred, SPHR highly desired.
Minimum ten (10) years of progressively responsible and directly related work experience in an HR role, with expertise in: religious accommodations, leave of absence and return to the workplace accommodations, specifically in a return to the workplace capacity; Employee Relations, Accommodations, Leave of Absence and/or Case Management experience in the disability/worker’s compensation/FMLA counseling arena preferred.
Three (3) years or more experience in high volume, complex case management required
Three (3) years or more knowledge and understanding of disability management; return-to-work strategies; religious accommodation laws and related HR compliance regulations required
Demonstrated expertise of federal and state applicable regulations, especially religious accommodations, disability laws, specifically ADAAA, FEHA and FMLA/CFRA; experience with CA leaves required
Ability to communicate decisions effectively and recognize legal risk associated with certain religious, medical and/or disability issues while prioritizing case elements.
Completion of specialized certification or training on accommodation administration a plus.
